How to File a DMCA Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on luxedecorator.com, please send a written notice to our designated Copyright Agent. Your notice must include the following specific information:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, or the subject of infringing activity. You must provide information reasonably sufficient to allow us to locate this material on our site.
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Luxe Decorator will promptly investigate any valid DMCA notice. This investigation may lead to removing or disabling access to the identified infringing material.
Counter-Notification Process
If your content has been removed or disabled due to a copyright infringement notice, you have the option to file a counter-notification. This process allows you to dispute the claim of infringement. For a counter-notice to be effective, it must be a written communication sent to our designated Copyright Agent and include substantially the following:
- A physical or electronic signature of the subscriber whose content was removed.
- Identification of the material that was removed or to which access was disabled. Include the location where the material appeared before its removal or disablement.
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
- The subscriber’s name, address, and telephone number.
- A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located. If the subscriber’s address is outside of the United States, consent to jurisdiction for any judicial district in which Luxe Decorator may be found is required. The statement must also confirm that the subscriber will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, Luxe Decorator may restore the removed material after 10 business days. We will do so no later than 14 business days, unless the copyright owner files a court action seeking an order to restrain the subscriber from engaging in infringing activity related to the material.
